So, of the nigh on 400 TVs supported in BBC iplayer for the Blue Planet II HLG episodes none are from Samsung. Oh joy.
...
Moderator edit: Original thread title was "Blue Planet 2 HLG - No Samsung". With the OP's permission, the title was changed on 12/03/2018 to accurately reflect the dominant theme of the thread as it has progressed. If the reader would like to know more about the HLG format, please check out the BBC's page and FAQ's on it here: http://www.bbc.co.uk/rd/projects/high-dynamic-range Thank you, AntS.

Did you do the letter of intent in person or by email?

Dear Dale,
Case Reference: *****
Thank you for your email dated the 4th January 2018.
I am sorry to learn you feel you were miss sold the TV you purchase. As you have not notified us in a reasonable amount of time after your purchase. The sales of goods act does advise that if an item is not fit for purpose then you can make a claim but this is referring to the working of the TV. As this item is not faulty we would not be able to take your claim further.
Please accept my apologies that I am unable to assist you further on this occasion.
Kind regards,

They are just trying to get out of it and hope you will go away. Point out to them that under the regs miss selling is a justified reason to ask for a refund. Point out you got this miss information from their web site, which they can check. Also put in the link. Again I did not expect anything less.
Sent my response already so lets see what they come back with now as I have threatened them with the small claims court.
It Say's customers should do their research and you did not contact within a reasonable time. First thing these things did not come with the TV but were an update. Everyone are being reasonable by giving Samsung reasonable time to supply said items(dongle) and updates. There us no time limit in the regs except the 6 year limit. There is no mention when you must make a claim. As I have said they are just trying their luck. Until they are legally threatened they will keep this attitude. Again though I doubt very much that they will actually go to court dew to the negative impact it will have. I had to issue a letter of intent to take legal proceedings. Then they agreed to a refund.

Sorry I was meant to quote you @daleski75 as it was your email I copied and sent to Currys.
Not holding my breath to be honest as can’t afford to start legal proceedings. Would be great if they did offer an exchange which I said on the email I’d be happy with also as the LG B7 is on offer at the moment.
Or I’d be happy with store vouchers if it came to it if they don’t want to provide a refund as such. Would just have to do with my old cheap LG (but doesn’t suffer from flickering playing PS4 or have juddering issues watching some programs on Sky like the Samsung does) until I saved enough for an LG.

No problem if any of my emails help then that’s great, the last couple of options available without going to court would be to write a letter of intent to go to court or to email the CEO of Dixon’s with what’s happened.
All of this will just make me boycott Currys for any purchases and will instead use JL who are happy to follow the law and offer refunds or replacements for mis-sold items.

Response from Currys looks like they are happy to go to court so next step is either a letter of intent to go to court or to write an email to the CEO of Dixon’s first to see what response i get back.

Nasty. Note again their attempt to get you on the phone.
Do not EVER speak to them on the phone. Insist that EVERYTHING is done in writing.
They are not above the law.
They are deliberately ignoring the new law. I agree with the other posts.
First, it doesn't cost you anything but a stamp to send a letter of intent. Not an email, a letter, sent Recorded Delivery. They love those.
And, it is very very cheap to lodge a case in the Small Claims court (that's what it is for). NB: "Small Claims" = up to £10,000.
https://www.moneysavingexpert.com/reclaim/small-claims-court
£25 - £410 Initial claim fee - to start your claim (when done online).
£40 Court allocation fee - to get the claim to the court (if claim is over £1,500).
£25 - £325 Hearing fee - paid if and when your case gets to court (when done online).
Cost to you: £25 x 2 isn't it? Which you get back when you win.
"If you win your case, you'll get the court fees back as well as the claim, and you can ask for certain expenses."

Dear Customer Service Team,
Please can you define a "reasonable amount of time" as I am 100% certain that the Consumer Rights Act of 2015 the consumer has up to 6 years to get back to any retailer if they deem the goods they brought faulty, not fit for purpose or not as described.
As stated previously Curry's are clearly at fault for not supplying the SmartThings Extend either with the television at the time and I have given plenty of time for Curry's to remedy this situation.
If this is your final say on the matter I will be writing a letter of intent to take Curry's to court and will also be contacting BBC WatchDog, Which and the CEO of Dixons that Curry's are happy to mis-sell goods to consumers and refuse to follow the law.
Regards,
Dale Kilborn

I believe if you lose you have to pay curry's for their court costs and any further damages they deem necessary for taking them to court, not sure if you need a solicitor though for the small claims court but happy to be corrected on this.

I think the issue here with miss sell maybe that if you purchased the tv with the understanding it would come with a dongle then it's reasonable to assume you would contact the company and let them know a bit closer to purchase date, this would have then demonstrated you purchased the product on the basis you would receive the dongle. Regarding the hlg support, providing you purchased after the media releases I think this would qualify in all instances specially given that we have only recently been able to test. This is only my opinion and I am aware of the various legislation around miss selling. I would however progress to small claims regardless it is likely currys would pick costs along with time and resource regardless and due to this quite possibly agree to settle prior to court regardless of if they agree or not
I can't believe Samsung have not just added this in for the other models, I love my ks9000 but really disappointed with this!

I do agree with what you said however in my opinion if the law gives you up to 6 years to ask for a refund/replacement then anytime before the 6 years is legally ok irrespective of how long you may of taken to get back to Currys.
I am happy to go as far as a letter of intent in writing as well as emailing the CEO but going to court is a different kettle of fish altogether.
