Hello I purchased a Samsung galaxy s23, Samsung buds 2 Pro and charger in store through Samsung finance. I traded in my old device towards the Samsung galaxy s23.

I called into store today to return the items however they have said I cannot return them due to the trade in.

After speaking to the citizens advice they have said under the consumer rights act 2014 I can return and cancel the contract with uses.

 

I am not bothered about the phone which I traded in just want the loan agreement cancelling and refunding, as anybody had this problem in the UK which has been bought in store not online.

I could be wrong, but the consumer rights 'distance selling rules' give cover for 14 days for the right of return, when ordered from online... but the item still needs to be in its resaleable original condition...I.e. unused. That is unless there is an obvious defect or fault.

The rules can be slightly different for shop bought items... as a buyer you had the chance to demo and try this in the store before you buy... so it makes the consumer rules a bit more complex... and I believe a refund is at the discretion of the shop whether they would agree to the return and refund.

Also, having signed your name on a finance agreement adds more complexity.

Although frustrating, I would expect the minute you walked out the store having had the chance to demo the phone, and then signing a finance agreement and trading in an old device, then you may not have any further consumer rights. Not unless you have a very good reason for a fault of the product...just a change of mind would not be a good enough reason... especially if it is now used for a few days.

I assume you are still within the 14 days cooling period ? Did you buy from a large chain like Carphone warehouse ? Both of these might give more hope... a bigger chain might be more likely to return... and perhaps if it was a very recent purchase. I assume you are within 14 days for S23... as it is only just released.

I am far from an expert though... so keep exploring the consumer rules if you are unhappy.

You must be seriously unhappy to consider sending all this back though... not happy with the S23 ?

You will need to check any relevant Cooling Off Period offered by the shop you purchased from.

Can you clarify where you purchased the items from ?

You'll need to also look at the small print and T&C's of the finance agreement you signed.

Hi, 

Thank you for your help, the phone has not been taken out of the box and is still sealed, the contract agreement says I have 14 days to cancel my agreement which I am still in due to only having the phone 3 days, I bought it directly from the Samsung experience store. 

 

They have said due to me trading my phone in I cannot return it but on further research I have found they won't refund the trade in value however will refund the cost of the new handset which they said they cannot do.

I'd cancel the finance agreement which you are fully within your rights to do so and take it from there. I wouldn't be surprised to see the shop change its mind about the refund.

To my knowledge, as long as the phone is still sealed, you can return it within the return window when buying in store. However, you can't return it is it's been opened as you had the opportunity to demo on store so you knew what you were buying.

You stated that it's still sealed so you should therefore be able to return it without issue. As for the phone you traded in, a value of the base trade in value of the phone would normally be given as a voucher.

This is how I know it to operate but things may have changed. As I see it, there is no reason this should not apply to you. Check the return policy of the store and return to them with your finding. I'm sure you should find something if use to you.
