As it stands, it is open at the moment for unlocked phones only, as far as I'm aware. Is your phone locked to a network or unlocked ?, as that would explain it.
I'm afraid that because you have got it through EE. You have extra software for network optimisations. This unfortunately means that your phone won't be eligible for the Beta program I'm sure that general release is not too far off as I'm finding quite stable
Current rumours are its likely to push from the end of this month - but that's dependent on latest rounds of testing. Certainly will be within Q4. That said, if you have an handset running a networks optimised firmware then you'll likely see an additional delay before you get it as it as the networks will be tweaking it for their specifics before its pushed out.
As Chris asked, fraud under what circumstances? If you're in the UK then have a look at Action Fraud website as that will give you some information and sign posting of who is best to contact.
