Samsung trade in - illegal notice on leaflet?

Was just looking at the leaflet that Samsung leaves you once you arrange a trade in with them.

I received my fold 6, but the leaflet says that it is our responsibility for the phone to reach Samsung in good condition and are not liable for any courier damage etc.. 

However they are the ones arranging delivery, so according to UK law, it IS their responsibility. 

My phone is high value, so worried about sending back if Samsung are going to be difficult about this

Does your trade in go directly to Samsung or a 3rd party?

It's the service advertised on Samsung website for the fold 6. All done on Samsungs website. It looks like the service is operated by a third party however, called Samsung recycle.

This should not matter though, as the whole process is advertised and operated on Samsung.com.

There's an option to pay for insurance on the product with royal mail when sending.

That would mean the responsibility is on the customer. And it would mean Samsung would charge you for the unreturned phone and you would have to claim with royal mail. Very messy process.

Either way, like I say, the return is arranged through Samsung. That is what I am taking issue with. It IS their responsibility to ensure the device reaches them. It is not the customer.

Maybe it's their way of distancing themselves from any come backs. I'm no commercial lawyer, so who knows. I've always arranged my own returns inc insurance and always taken time and dated photos of the device to be returned.

I think I'm gonna do the same, as it's not worth the hassle dealing with Samsung if something goes wrong. Bad form though.

Agreed. Nobody needs the hassle of a legal battle with Samsung.

Ok, maybe worth emailing samsung customer services team, or maybe doing the contact a ceo (you can search this on google)

I've done the ceo contact before and they are pretty helpful.

I did read something that says that thr company is usually liable for returns but this depends on the terms and conditions of the retailer.

It's your responsibility to document the condition of the phone and the packaging to be sufficient to prevent any damage in transit.
The trade in return is the basic service and will be delivery only
They cannot be held responsible for any damage due to poor packaging.

Personally I'd highly recommend paying for a signed for service with a compensation amount sufficient to cover losses should something happen.
