Photo Awards (Perfect Pairs contest) Terms and Conditions

By entering this competition (the “Competition”) you (the “Participant”) agree to be bound by these terms and conditions (“Terms and Conditions”).

Article 1

The Promoter

The Promoter of this Competition is Samsung Electronics (UK) Limited, 2000 Hillswood Drive, Chertsey, Surrey, KT16 0RS (the “Promoter”).

Preliminary stages of The Perfect Pair photo competition (“The Competition”) were run separately in each of the participating Samsung affiliates (each a “Samsung Affiliate” to select the best Perfect Pair photo. (Each preliminary stage is hereinafter referred to as a “Local Contest”.)

The final stage of the Competition is a Europe-wide virtual award ceremony event, taking place on 17 November 2023 at 5pm], to which the winners of each of the Local Contests is invited (the “Award Ceremony”). Details on how to join will be sent by email .These Terms and Conditions only apply to the final virtual event, and selection of the grand winner. Separate terms apply to the Local Contests.

Article 2 – Principle of the Competition

The Samsung Affiliates organising each Local Contest will email an invitation, incorporating these Terms and Conditions to winner of their Local Contest (“Local Contest Winner”).

To participate in the Award Ceremony, each Local Contest Winner must accept these Terms and Conditions and commit to attend the Award Ceremony by joining the virtual event using details provided by the Samsung Affiliate organising their Local Contest.

Article 3: Selection of the winner

Promoter will arrange for a jury of Samsung Community star users (the “Jury”) to consider each of Local Contest winning photos and choose two overall winners of the Competition. The jury will select the winners based on the following criteria:

Photo quality
Link between the content and the theme of the competition
Creativity
Staging of the content
Innovation

The Jury's decision will be made ahead of the Award Ceremony but not disclosed beforehand. The Jury’s decision is final.

There will be two (2) winners in total (each a "Winner").

Article 4: Announcement to the winner

The Winners will be announced during the Awards Ceremony. The Samsung Affiliate whose Local Contest they won will then contact them to arrange delivery of the Prize.

The Promoter reserves the right to select another Winner in the event of a non-attendance by the Winner at the Award Ceremony, or of a refusal or non-receipt by the Winner of his/her prize or if his/her participation proves invalid or for any reason that does not allow him/her to be awarded his/her prize. The Winner will not be entitled to any dispute and the prize will be forfeited for that Winner without being able to make any subsequent claim.

Article 5: Prize

The prizes for the Competition (hereinafter the "Prize") are as follows:

The Promoter reserves the right to replace the Prizes, in whole or in part, with other prizes of an equivalent nature, if circumstances beyond its control force it to do so, without incurring any liability for this fact. The Winner has no right to request the provision of an alternative to the Prize such as a cash payment of equivalent value.

Article 6: Delivery of the Prize

The Samsung Affiliate whose Local Contest they won will then contact the Winner after the Award Ceremony to arrange delivery of the Prize.

The Prize will be sent to the Winner by within two months of receipt of its confirmation by the Promoter.

This period is given as an indication and is subject to modification in the event of exceptional circumstances that would be external to the Promoter, in particular in the event of force majeure, which the Participant accepts.

In the absence of collection of the Prize from the postal services and therefore in the event of return of the Prize to the Promoter, the Winner will be considered to have renounced the Prize.

Article 7: Limitation of liability

The Promoter shall not be held liable in the event that a Participant is unable to connect to the Award Ceremony due to any technical fault or any problem related, in particular, to network congestion. It cannot be held responsible for the maintenance or any malfunction of the servers on which the Competition is hosted.

It is the responsibility of the Participants to take all appropriate measures to protect their data and/or software. The connection of any person to the Site and participation in the Competition is the sole responsibility of the Participants. The Promoter shall not be held liable for any damage caused to the Participants, their computer equipment and the data stored therein, as well as for the consequences that may result from it on their personal or professional activity, except in the event of direct and exclusive fault on the part of the Promoter.

The Promoter cannot be held responsible in the event of theft, misdirection of mail or damage to the Prizes by the postal services. The Promoter cannot be held liable in the event of incidents that may occur as a result of the use or non-use of the Prize.

The Promoter is not obliged to respond to requests from Participants, in any form (letters, e-mails, faxes, telephone calls, etc.) relating to the mechanism of the Competition, the interpretation or application of the Rules, or to the winner, even after the Competition has closed.

By agreeing to participate in the Competition, each Participant is deemed to have accepted the Rules and fully and unconditionally releases the Promoter from any liability relating to the Competition as well as any harm, loss or damage that may arise as a result of participation in the Competition or in connection with it.

Any changes will be notified in advance by any appropriate means. Additions and amendments to the Rules may then be published during the Competition. They will be considered as amendments to these Rules.

Article 8: Privacy and Data Protection

In order to comply with its obligations under the Terms and Conditions, the Promoter will process Participants’ personal information in order to:

Validate participation in the Competition (Verification of the candidate’s eligibility according to the criteria requested for the Competition as indicated in the Rules)
Communication between the Promoter and the Participants, among other things to inform the Winners of the results
Delivery or dispatch of Prizes

The Promoter shall process Participants’ personal data in accordance with its Privacy Policy available at https://www.samsung.com/uk/info/privacy/ The Participant may withdraw consent to such use of personal information by writing to the Promoter or by using the opt-out process outlined in the Promoter’s privacy policy.

Other than as set out in these terms and conditions or for the purposes of operating the Promotion, the details and information provided by the participant when entering the Promotion or claiming a prize will not be used for any promotional purpose, nor shall they be passed to any third party.

Article 9: Publicity and promotion of the Winner

Each Participant, by participating in the Competition alone, expressly authorizes the Promoter to use, on any medium, by any means and for the duration it deems useful, his or her surnames, first names, cities of residence, as well as the photographs taken in the context of the Competition for the purpose of ensuring communication relating to the Competition, the promotion of the Promoter's games and competitions, for a period not exceeding three (3) years from the beginning of the Competition Period, without this conferring on the interested party the right to any additional remuneration, compensation or benefit other than the award of the prize won in the Competition.

Article 10: Applicable law and dispute resolution

The Competition and its Rules are subject to English law.

Any dispute that may arise during the execution of the Rules will be resolved amicably between the Promoter and the Participant concerned.

Claims or disputes arising from the interpretation or execution of the Rules must be submitted by the Participant to the Promoter, within one (1) month from the deadline for participation in the Competition as indicated in the Rules, by registered letter with acknowledgement of receipt addressed to:
