So, of the nigh on 400 TVs supported in BBC iplayer for the Blue Planet II  HLG episodes none are from Samsung. Oh joy.

If you lose

If you lose the case, you may have to pay the trader's costs if they ask the court for them to be paid. You'll also have to keep to the terms of any court orders that the judge makes against you.

That isn't what they said Dale: "should you wish to accept the offer you may keep the Samsung TV and the voucher can still be issued to you as a gesture of goodwill to bring the issue to resolve".

 

That being said I very much doubt you will ever spend another pound in a Curry's shop anyway.

In previous emails they stated it would be a replacement tv, need clarification now.

On another note I have heard back from RS again and the store manager of the branch I bought it from is checking with head office to confirm I will be able to chose another brand but in his own words - "I should think that it wouldn't be a problem to go for another brand of television. I'll let you know what they say once I've spoken to them tomorrow."

In all honesty I was expecting a proper fight like you have had with Curry's but so far there has been no push back at all.

I think John Lewis are not doing themselves any harm with their response so far, and I think I would recommended buying from them in future. I wonder what Curry's thing about JL response, and hopefully they may learn abit about customer satisfaction.

Samsung have offered a resolution that would put you in a similar position as receiving the Dongle with the offer of a free SmartThings Hub. A “similar” position is not the same as what I originally brought the television for as the Smart Things Hub cannot be used with the television, as your stance is the same I will be proceeding with the small claims court by the 25th and Curry’s will be served notice for mis-representation.

I am surprised how quickly they are getting back to you. It's interesting how the last offer was finale and now the offer is the voucher as compensation. Do you want to spend your money at Curry's? 


Definitely no and the voucher would mean I would have to hand back my 55KS7000 for a far inferior tv. I think Curry's are calling my bluff and reckon I won't go to the small claims court.


 

 

I read it this time that you keep your telly and they will give you the voucher for £550 ish. It's an improvement, but JL has given someone a proper replacement to the same value.

my retailer just emailed saying they are willing to exchange a tv for a similar model like for like i mailed back thanking them for their offer but i canot accept a samsung as i have no faith in the brand anylonger after the last years runaround i have had forom them and i wish to have a lg oled and are willing to pay the extra for such a tv

we will see what happens next.

That's if you lose, when you win you get your costs. Cab  told me as far as they are concerned, and with the in formation I gave them they are guilty of misrepresentation, therefore they have no defence therefore they were highly unlikely to actually go to court. I got my refund for a JS8000, when I served the the legal papers on them, intention to take legal action by recorded mail with all the evidence, sent to the Stockport store. That was because itcwascsold as fully HDR yet when Netflix first broadcast in HDR it could not received it. Took me 4 months of emails and calls to get enough evidence for them to hang themselves but I got there. What makes this easier is they have admitted misrepresentation, so we have the evidence. It seems that John Lewis have accepted this, so I think Curry's have little choice in the end.

That's excellent, I think someone else was offered the same and has asked for a different brand. Would you post your result onto AV Forum's ks8000/9000 thread.

It also seems that Richer Sounds are also doing the right thing. Does any one think Curry's would go to court when their main rivals are excepting misrepresentation and exchanging sets like for like? Just a matter of time when Curry's will do the same. Might also be worth mentioning to Curry's about their rivals good response and customer support, clearly lacking from Curry's.
