It's not a problem we have heard about before, but it sounds like VRR PS5 range is between 48Hz – 120Hz, so you will not benefit VRR on games running 40Hz. In contrary you can get judder instead.

“The VRR range on PS5 is also capped to 48Hz - 120Hz, which isn't as good as what's available on the LG OLED CX, which has a superior VRR range of 20 - 120Hz. This means that if a PS5 game drops lower than 48fps when playing at 60Hz game, it may exhibit judder as it falls out of the VRR range.”

Don't know how accurate this list is, but it looks like games need to support, or rather be optimized for VRR as well.
