Yea I appealed but I haven't heard anything since middle of April.

Is anyone in the process of taking Currys to court?

I've just sent an email to the Ombudsmen stating my section 75 claim.

I've also just heard back from my CC company, was informed my section 75 was not upheld, saying they believe the tv has fufilled its basic functionality, to watch programmes and this itself was not misrepresented. 

So I was given 3 options by Currys:

1. A £150 currys voucher and I keep the TV

2. A £800 currys voucher and towards a new TV with Currys and I send back TV

3. Contact Samsung to get free SmartThings Hub v2

 

I was advised the 2nd was the better option on the table otherwise I can take Currys to court or Complain further to my CC.

 

Not sure I got the patience anymore, this section 75 claim has taken 3 months.

Your choice but I expected that. You can now appeal, then FO.  Still all free to do.

I think I'll escalate this to the FO, 3 months and to be honest it's the same answer as Currys. While they made the distinction about tv functionality I don't see it as a separate, but look at it as what is is a TV which was sold to be with xyz features. Which made it the reason for me buying the TV in the first place over other TVs at the time.

Their £800 offer make look good, but it has to be spent on Currys only, which means they already have a big markup, and I would be out of pocket now to try and get a TV with similar spec as mine. Mine being a KS8000 = Q80R that is £2K at the moment.

Currys refunded me for the TV last night.  Store manager stated that Samsung has now approved the refunds for misrepresentation and that is the reason for the turnaround.

the receipt says Misrepresented Sale.

Just waiting on the money back from the finance company before deciding on the new TV.  Not sure whether to get the 2018 Panasonic OLED or wait for the new one due out soon.

That's great news. Could it be that Curry's are going to now pay out for all of their owners. 

Long battle but great.
