As you can see, they have offered me the Smart Thing Extend twice by mistake. Would you guys think that is blantent direct misrepresentation and should now offer the exchange or full refund? 

 


It is misrepresentation but under consumer law  it is the retailer not the manufacturer who is responsible so in that regard Samsung are correct.  

If you are certain that you saw the dongle advertised online then even if they have remover the advertised there will still be an archived version online. But you have to show that the retailer did advertised that function.

Regarding Barclaycard and the person having issues, mine was a while ago and I posted it at the time but Barclaycard also allowed my claim. They offered me a reduction for usage and return the tv or 50% refund and keep the tv. I think I could’ve pushed for a full refund and return, but  I took the second option as I decided it was fair.

 

So I’m not sure why they’re giving you a hard time.

 

Don’t forget if anyone else is in this situation where they get a partial refund and keep the tv to also claim the SmartThings hub from Samsung as it’s unrelated to the partial refund. I did this and then just sold it on eBay as it still doesn’t do the functionality I originally wanted of controlling via the tv so is no use to me - and selling it brought the tv price down further.

When we first started this thread someone got over half the value and kept the TV,  since then they have played hard. The problem with consumer law is they are not committing a criminal offence so so think they don't have to comply until forced,  which means court or a section 75. We know they are in the wrong because Barclays credit and Tesco Credit have both been given full refunds. The Alternative Dispute resolution arbitration have ruled against Richer Sounds and they are giving full refunds. John Lewis have given some refunds. If there was no misrepresentation then there would have been no refunds. 

So even though Curry's are still holding out it is still worth starting the process now,  because once they buckle your claim is in and it puts more pressure on them.

I have also just arranged the mediation day with John Lewis, after a long and protracted small claims case. So in a couple of weeks I will jump through that loop and see if a reasonable refund can be made

Thanks You. I have raised a complaint with them this morning. Let's see what their response is. If they are going to mess me about, i will let my friend (a lawyer) respond.

 

Does anyone have the original screenshot form the Curry's website as evidence of the mis-seling? I can't find it anywhere

They did try to say Knowhow were not part of Curry's but soon changed that and agreed it was.
