That's as maybe but they clearly have never heard of the Small Claims court. I bet they'd answer a summons from that Court, they can ignore it at their peril "because it didn't come from your solicitor" at their peril.

Again, it's just bullying tactics.

This is all baloney, you do not need a soliciter even for a criminal case you can represent yourself - please include loss of wages in your claim for every second you spend on this matter

They are clutching at straws as said, you do not need to be a solicitor to start small claims proceedings or section 75 credit card claim. As said it is another tactic to put you off and hope you will go away. But it leaves the Curry's customers with a possible need for small claims or at least to take the first steps with an intention to take legal action. You do not need a solicitor just the facts and the relevant regs. All the evidence is on these and KS refund info thread, and don't forget all the different excuses they have used to try to wriggle out. I think this is their legal department trying to shut this down by intimidation. They also have compensated one member with over £500 worth of vouchers which to me is an admission of guilt and by offering the free Samsung hub. With the ADR result confirming this is clear misrepresentation.

I would very much doubt they would actually let this go to court, because if they did and the lost it would open the doors for every Curry's KS owner asking for a refund! What a lovely day that would be!

On the contrary, I have a suspicion that they might want a case to go to court. That's maybe the only way they'll be able to get Samsung to take the TVs back. Who knows what's in their supply contract with Samsung.

Posible but very unlikely, Samsung have lost market share in 2017, 2018 does not look good either, if retailers like Currys and JL start piling up Sqamusng have got a lot to loose not in only in UK but in whole Europe

I agree and think the climate for the retailers is quite difficult and with social media being able to wreck the reputation of Curry's and John Lewis I think the fact of major retailers being taken to small claims court for miss-selling would be highly embarrassing, and if they lost the bad publicity would be great for us and disastrous for them. It would look like the little man having to fight the big companies for their rights, not good. Richer Sounds on the contrary by being signed up to the ADR and complying with the ADR ruling have done nothing but impressed everyone (nearly) here. I would think they may try to settle each case before a court with a gagging order, but I do hope people who have used these threads do not accept that because everyone needs to know of every result.

Hi quick update on my claim.  I went to currys this morning to take a look at some TVs so I could offer some suggestions after they suggested a Q6FN as a replacement to my ks9000.  After speaking to them again after suggesting OLEDs in the 2800 range (I paid 2900 for my ks9000) they were unwilling to offer higher than the low end tv but it’s value was £2500. So I’ve paid extra and gone for a Sony OLED at 3100 after 200 off the price due to some offer.  My ks9000 was taken back paid the extra and walked away.  I did ponder the legal route but for £400 difference I was happy enough but I didn fancy it to court but didn’t fancy getting all the documents prepared etc like mentioned earlier and possibly messing something up and losing.  So £200 a year I have lost but I can live with that.  Just getting my OLED setup ready for England match

 Thats brill, so it looks like Curry's are coming around, pity though they still holding out on the full refund, but far better than the Samsung hub they were offering. Can you tell us which branch it was?

I finally had a response from my section 75 with my credit card, they want me to post them (not email, annoingly) a list of the following;

 

  1. Invoice/contract - got
  2. Copies of any correspondance between you and the merchant - got
  3. Copy of the terms & conditions including refund/returns policy - I will need to find from John Lewis website - I suspect I need the 2016 version.
  4. Written confirmation of reason for delay as item in dispute was purchased in 2016? Confirmation if the TV was used? - Obviously used. I bought in Aug 2016 and saw the dongle advert from Samsung exec and on John lewis website and spoke to some in store. Does anyone have any other views on this, which could state my case more strongly?

Interesting as I know someone else had it rejected on the assumption it was a free addon, bit like apps, where it is actually part of the spec of the TV. They have appealed. 

1 and 2 ok

3, It will be on their site and will probably say they are not responsible for apps so make sure you cover that possible excuse.

4, quite easily you were waiting for the dongle and have asked for it and it was only this year that Samsung confirmed that they would not be releasing the smart things connect dongle, which is dated,

 

And this is the official statement from Samsung saying they will not release the Smart Things Dongle.

"Unfortunately, for technical reasons we were not able to release the SmartThings Extend in the UK.
